3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any conduct that we determine is harmful to the Service or other users.

5. User Content

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing and improving the Service.

5.3 Content Standards

You represent and warrant that your User Content:

• Is accurate and truthful
• Does not infringe any third-party rights
• Does not contain defamatory or offensive material
• Does not violate any applicable laws

6. Subscription and Payment

6.1 Free and Paid Services

We offer both free and paid subscription tiers. Some features are only available to paid subscribers.

6.2 Billing

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method on a recurring basis
• We may change our fees with 30 days' notice

6.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

7. Intellectual Property

When we submit job applications on your behalf, you acknowledge that:

• Each employer has its own terms and privacy policies
• We are not responsible for employers' actions or decisions
• Job listings may contain inaccuracies or be outdated
• We do not guarantee job placement or interview success

9. Disclaimers

9.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9.2 Job Search Results

We do not guarantee:

• The accuracy or completeness of job listings
• That you will receive interviews or job offers
• The quality or legitimacy of employers
• That job matches will meet your expectations

9.3 AI Limitations

Our AI technology, while advanced, has limitations. Resume optimization and job matching are based on algorithms that may not capture all nuances of your qualifications or job requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOPTO.IO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Damages resulting from your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access or alterations to your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO US IN THE PAST TWELVE MONTHS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jopto.io, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

13. Dispute Resolution

13.1 Informal Resolution

13.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in San Francisco County, California.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service at least 30 days before taking effect. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jopto.io regarding the Service and supersede all prior agreements and understandings.
